These terms govern your use of this website and your request for a consultation with Essential Coverage Inc (“Essential Coverage,” “we,” “us”), an insurance agency owned by Clark Guo. By using this site or submitting the consultation form, you agree to them. If you do not agree, please do not use the site.
1. We are not the government
Essential Coverage Inc is a private insurance agency. We are not connected with or endorsed by the United States government, the Centers for Medicare & Medicaid Services, or the federal Medicare program. This is not an official Medicare website. For official information, go to Medicare.gov or call 1-800-MEDICARE.
2. We do not represent every plan
We do not offer every plan available in your area. Currently we represent [NUMBER] organizations which offer [NUMBER] products in your area. Any information we give you is limited to the plans we do offer. Please contact Medicare.gov, 1-800-MEDICARE, or your local State Health Insurance Program or 1-800-MEDICARE to get information on all of your options. Free, unbiased counseling is also available from New York's State Health Insurance Assistance Program, HIICAP, at 1-800-701-0501.
3. What this website is
This site exists so you can request a consultation with a licensed agent. It is informational. Nothing on it is an offer of insurance, an application, a quote, a guarantee of eligibility, or a binding of coverage. No coverage begins, changes, or ends because of anything you do here, and enrolling in a Medicare plan is a separate step you take later, in writing, if you decide to.
4. Not professional advice
Content here is general and is not legal, tax, medical, or individualized financial advice. Medicare plan availability, benefits, provider networks, drug formularies, and costs vary by county and by carrier, and they change every contract year. Do not act on general information here without a consultation about your own circumstances, and always confirm details against the plan's own official materials before you enroll.
5. Licensing
Clark Guo is an insurance producer licensed by the New York State Department of Financial Services. We can advise on and place coverage only where we hold an active license and an active appointment with the carrier. If you are outside that area, we will tell you promptly and point you somewhere useful.
6. Consultation requests and Scope of Appointment
- Submitting the form is a request, not a confirmed appointment. An appointment exists only once we confirm it by email.
- Medicare rules require a documented Scope of Appointment before an agent may discuss specific Medicare Advantage or Part D plans with you. It records only the product types you agreed to discuss. You may narrow it, expand it in writing, or withdraw it at any time, and we keep a copy for ten years as the rules require.
- For in-person appointments, the Scope of Appointment must be in writing.
- Consultations are free. You are never charged by this office and never obligated to enroll in anything.
- We may decline or reschedule a request for any lawful reason.
- Advice is only as good as the information behind it, so please give us accurate details about your doctors, prescriptions, and current coverage.
7. How we are paid
You pay us nothing. If you choose to enroll in a plan through this office, the insurance carrier pays us a commission, capped by the Centers for Medicare & Medicaid Services at the same amount across plans of the same type so that our pay does not steer our advice. We will tell you plainly if a plan you are considering is one we do not represent or cannot be paid on, and we will still tell you it exists.
8. Recorded conversations
Medicare rules require that marketing, sales, and enrollment calls between agents and beneficiaries be recorded in their entirety, including the audio of video calls. If we speak with you about Medicare plans by phone or video, that conversation is recorded. We keep marketing and sales recordings for at least six years and enrollment records for ten years, stored securely with restricted access. We will tell you at the start of the call.
9. What not to send through this website
This form is not a secure channel. Do not submit your Medicare Beneficiary Identifier, Social Security number, driver's license number, bank or card numbers, or detailed medical or prescription information through it. We collect those, when they are needed, through secure methods at the appropriate stage. We do not ask for your telephone number on this website and there is no field for one.
10. Contacting you
Submitting the form is your permission for us to email you about your request. It is not permission to call or text you, and it is not consent to receive marketing from anyone else. You can withdraw it at any time by replying to any message from us or writing to contact.health.clarks@gmail.com, and we will stop.
11. Acceptable use
- Do not submit another person's information without their permission. If you are helping a parent or relative, say so, and we will ask for their authorization before discussing their coverage.
- Do not submit false, misleading, or automated submissions.
- Do not interfere with, scrape, overload, or attempt unauthorized access to this site.
- Do not use this site for any unlawful purpose.
12. Our content
The text, design, layout, and logo on this site belong to Essential Coverage Inc or are used with permission. You may view and print pages for personal use. You may not republish, sell, or reuse them commercially without our written permission.
13. Third-party links
We link to carriers, Medicare.gov, and other outside resources. We do not control them and are not responsible for their content or practices. A link is not an endorsement.
14. Availability and accuracy
We try to keep this site accurate and available, but we do not promise it will be uninterrupted, error-free, or current at all times. Plan information changes each contract year. We may change or remove content at any time.
15. Accessibility
We want this site usable by everyone, including people using screen readers, magnification, or keyboard navigation. If any part of it gets in your way, write to contact.health.clarks@gmail.com and we will fix it and give you the same information another way.
16. Disclaimer of warranties
To the fullest extent the law allows, this website is provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
17. Limitation of liability
To the fullest extent the law allows, Essential Coverage Inc and its officers, employees, and agents are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising from your use of this website. Nothing here limits any liability that cannot lawfully be limited, and nothing here limits the professional duties we owe you as your agent once we are engaged.
18. Indemnity
You agree to indemnify and hold harmless Essential Coverage Inc from claims and costs arising from your misuse of this site or your violation of these terms or of any law or third-party right.
19. Complaints
If you are unhappy with how you were treated, tell us first at contact.health.clarks@gmail.com. You may also call 1-800-MEDICARE, contact the New York State Department of Financial Services, which licenses and regulates insurance producers in this state, or reach HIICAP at 1-800-701-0501. Reporting us costs you nothing and we will not treat you differently for it.
20. Governing law
These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in [COUNTY] County, New York, and you consent to their jurisdiction.
21. Changes
We may update these terms. The date at the top shows when they last changed. Continuing to use the site after a change means you accept the update.
